Judge’s Order Is MASSIVE Blow To Gun Control Group, Sets Awesome Precedent.

by Sean Brown

“A prominent gun control group brought a lawsuit up against a gun dealer, and when it got to the federal level, the judge made a major decision, delivering a massive blow to the organization and setting an absolutely awesome precedent for future suits.

I’m sure many of you have heard about the Brady Center to Prevent Gun Violence, as they’re the group responsible for the so-called “Brady Ban,” signed into law by then President Bill Clinton, which banned semi-automatic hunting rifles and high-capacity magazines for a 10-year period. Well that ban expired, and in a push to enact back-door gun control on America, the group brought a lawsuit against an online gun dealer in an attempt to hold them responsible for the vicious movie theater shooting in Colorado, but it just backfired in a major way.

According to the Washington Free Beacon, Judge Richard P. Matsch completely obliterated the organization’s argument for the lawsuit and delivered an even harder blow when he ordered them to pay the legal fees for Lucky Gunner, who was the defendant in the suit. Awesome, right? Just wait until you hear what he said.

Matsch dismissed the suit, which argued that the manner in which Lucky Gunner sells ammunition is “unreasonably dangerous and creates a public nuisance” and attempted to hold the business partly responsible for the 2012 massacre perpetrated by James Holmes.

“A crazed, homicidal killer should not be able to amass a military arsenal, without showing his face or answering a single question, with the simple click of a mouse,” Brady Center’s Legal Action Project Director Jonathan Lowy said at the time. “If businesses choose to sell military-grade equipment online, they must screen purchasers to prevent arming people like James Holmes.”

Ridiculous, right? Well, Matsch agreed, and in his scathing ruling, he accused the Brady Center of “propagandizing” the public and using the lawsuit to advance a political agenda.

“It is apparent that this case was filed to pursue the political purposes of the Brady Center and, given the failure to present any cognizable legal claim, bringing these defendants into the Colorado court, where the prosecution of James Holmes was proceeding, appears to be more of an opportunity to propagandize the public and stigmatize the defendants than to obtain a court order,” Matsch’s order read.

Now that’s a judge with some sense. Naturally, Lucky Gunner was elated with the ruling and vowed to recover every last penny they spent trying to defend themselves from the frivolous suit. They also said that when they do, they’re going to donate the money to a gun rights group, which is yet another slap in the face to the anti-gunners at the Brady Center.

“The federal judge on the case ruled it was apparent that this suit was filed to pursue the Brady Center’s ‘political purposes’ and was used as an ‘opportunity to propagandize the public,’” Lucky Gunner spokesman Anthony Welsch said. “Lucky Gunner agrees with the court’s assessment and continues to do all it can to hold the Brady Center accountable for legal fees awarded in the case.”
